Part I: General Information About ZooBurst

1. What is ZooBurst?

ZooBurst is a digital storytelling tool that is designed to let anyone easily create his or her own customized 3D pop-up books. Using ZooBurst, storytellers of any age can create their own rich worlds in which their stories can come to life. Using a novel web-based framework, users of ZooBurst can view and create their own 3D pop-up books using nothing more than a standard web-browser outfitted with the Adobe Flash plug-in. Users can drag and drop various types of media, such as images, sounds and video, onto a 3D canvas and watch as their stories take shape and literally "pop" right off of the page. In addition, users that have a web camera installed on their computer can choose to experience a ZooBurst book using a technique called "Augmented Reality." By holding up a printed symbol in front of the camera, users can watch as their own book appears to "fly" out of the paper and appears right before their eyes.

2. User Accounts

Anyone with a valid e-mail address can sign up for a "basic" ZooBurst account. Once registered, users can elect to upgrade their account to a "premium" account. Full details on the features and pricing associated with both accounts can be found on the Pricing page.

3. Signing Up for a ZooBurst Account

New accounts can be obtained by anyone over 13 years of age with a valid email address. After filling out a brief form and verifying your e-mail address, you will immediately gain access to ZooBurst as a "basic" account holder.

4. What information is requested during account creation?

All users are asked to supply the following information when registering for an individual ZooBurst account:

Privacy is a chief concern of ours, and information supplied during the registration process will not be released or publicly printed on the Internet. We will not nor do we have plans to sell personal information to 3rd parties. We may on occasion contact users about new features or services that have been added to the ZooBurst website. For these kinds of mailings we provide an "opt-out" feature on a user's profile page. We do reserve the right to contact users for issues that relate to the security of the ZooBurst site or a user's individual account. Note that profile information (First Name, Last Name, E-mail Address, Password and "opt-out" indicator) can be changed by a user at any time by visiting their profile page within the system.

6. What kind of identifying information is displayed on the web?

During the account creation process the user will be able to select a "display name" that will be used in lieu of their real name or e-mail address for purposes of identifying the ownership of materials (i.e. books) on the website. Users have the ability to set up their display name upon registering for the site so long as there is not an internal conflict with a selected name (i.e. names must be unique within the system) and the name selected is not offensive, lewd or obscene or inappropriate. ZooBurst reserves the right to deactivate accounts that utilize offensive, lewd or obscene display name. Users who choose to fill out their public ZooBurst profile may choose to make additional information available as well.

7. Basic Accounts

All accounts default to a "basic" account upon registering with ZooBurst. Basic accounts are free of any usage charges and allow individuals the ability to explore ZooBurst and experiment with its capabilities in a feature-limited fashion. Certain features, such as audio integration, book privacy options, classroom management and the ability to have an ad-free browsing experience on the ZooBurst site are reserved for premium account holders.

8. Premium Accounts

Basic account holders may, at any time, choose to upgrade an account to a premium account in order to gain access to member-only features. Premium accounts are sold as a subscription service, and as such a premium account will retain access to premium content as for as long as the currently paid subscription is in place. If a subscription to a ZooBurst premium account is not renewed the account in question will revert back to a "basic" account automatically. Please see the Pricing page for more information about pricing options and features available under each account class. ZooBurst reserves the right to add, remove or update features available to account holders at any time.

Please note that premium account holders can choose to cancel the re-billing of their premium account at any time. If canceled, users will retain access to all premium features until their account automatically reverts back to a Basic account. We are unable to offer refunds for unused premium account time.

9. Paying for a ZooBurst account

ZooBurst utilizes the Amazon Payments system. This 3rd party vendor handles credit card transactions on behalf of ZooBurst. Individuals need to provide their billing credentials directly to Amazon to be handled and processed before Premium access to ZooBurst is established.

10. Media

Users with basic and premium accounts can build their own books using ZooBurst. ZooBurst provides a searchable database of over 10,000 images that are in the public domain as provided by the Open Clip Art Library (http://www.openclipart.org). Premium users can browse a collection of sound effects that can be added into their books as well. Information about the source of these libraries can be found under the 'Software' heading of this agreement.

In addition, both Free and Premium users have the ability to upload materials from their own computer into their ZooBurst books. ZooBurst users take full responsibility for the copyright status of the materials they upload into the system. If material has been found to be in violation of this policy ZooBurst reserves the right to remove the offending material and/or deactivate the account in question. In addition, users are advised that the Individual side of ZooBurst is a family-friend, PG-Rated website, and as such materials that are offensive, lewd or inappropriate for our target audience will not be tolerated.

11. How long will information stay on ZooBurst?

ZooBurst books will remain active on the site indefinitely as long as the owner of the books logs into ZooBurst on a regular basis or is continuing to pay his or her account on a regular basis. If the owner of a book does not log in for an extended period of time (1 year) their account and all of their books will be removed from the system following an e-mail alerting them of this impending action. Premium members who "downgrade" to a basic membership plan will retain their premium content in the system at its current Premium level (i.e. books that use premium features, such as audio integration, will not lose audio integration when the user downgrades their account). These books can be edited, but the premium features within them will become "locked" and cannot be modified in any way other than removing the material entirely from a book.

12. ZooBurst for Educators

Premium account holders have access to a number of ZooBurst features that support its use in a classroom setting. In particular, premium account holders have access to a "classroom management" mode that allows them to create accounts with ZooBurst on behalf of their students.

Classroom management mode also allows teachers to set up "classes" within the ZooBurst system. Teachers can establish privacy settings for a class and can classify books created within the class as being public to the world, password protected or private to just the class. In addition, teachers can sign up a large number of students for their class without having to input an e-mail address for each student. When creating student accounts no identifying information about a student is stored on the ZooBurst system other than a teacher-assigned username.

Teachers are fully responsible for content generated by their students. If books within a given class are public visible, a "flag as inappropriate" link will be made available to ZooBurst users to alert a teacher that inappropriate content may be included in his or her class. ZooBurst reserves the right to contact teachers and remove the offending content and / or student account.

By their nature, educator accounts are premium accounts, and will exist in their fully functional mode as long as a subscription plan has been paid in full. Upon the event of a teacher canceling his or her account all content will revert to a "read-only" mode. In read-only mode both the students and teacher will still be able to log into a ZooBurst class, but all books will be "locked" - the only feature that will be available to a user is the ability to delete the book from the system. This read-only mode will persist as long as the account holder regularly logs into ZooBurst. "Read-only" classes will be deleted if the account holder does not log into ZooBurst for one year.

Part II: Terms of Service

1. Terms

By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. Permission is granted to temporarily access the ZooBurst 3D Pop-Up Book authoring and viewing environments on ZooBurst's web site for personal and academic use only. This is the grant of a license, not a transfer of title. The details of this license are as follows:

This license shall automatically terminate if you violate any of these restrictions and may be terminated by ZooBurst at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

ZooBurst makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. 8. User Comments

You are prohibited from posting or transmitting any unlawful, threatening, defamatory, libelous, obscene, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense or give rise to civil liability, or otherwise violate any law.

9. Limitations

In no event shall ZooBurst or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on ZooBurst's Internet site, even if ZooBurst or a ZooBurst authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

13. Liability for the content entered by the User

a) The User shall be liable for any data or content he/she has uploaded into the ZooBurst system.
The User understands and accepts that any data or content provided by him/her through the ZooBurst system

- shall not infringe the rights of third parties, including but limited to copyright, other intellectual property rights, general personal rights, rights to business secret and other rights,

- may not be used by a third person
- shall comply with and all any individual particular instructions specified herein
- shall not include any pornography
- shall not include any other material that could give rise to any civil or criminal liability under applicable law

b) ZooBurst shall not be held responsible at all for:
- correctness, content, functioning or safety of data or content of any users
- damage (if any) caused due to use or presentation of data or content of any users on the system and in other media
- illegal acts (if any) of third person, as a result of which these persons may obtain access to the data or content of individual users and/or to their accounts and/or relevant database of ZooBurst or its partners using the services , and will not use or misuse the data or content or make them accessible to third persons illegally
- damage (if any) caused if data or content gets lost or becomes damaged

The User declares that he/she is aware of any and all risks arising for him/her from the aforementioned requirements for the data content entered by him/her. In connection with use of the system, the user especially undertakes not to breach legal standards of his/her country and the copyright license rights held by third parties.

The User shall be solely responsible for any data/content he /she has recorded on their system/server and the consequences of publishing them. The user shall be solely responsible for compliance with all provisions of these Usage terms and conditions. The user agrees to indemnify, defend and hold ZooBurst, its officers, directors, employees, agents, licensors, suppliers and any third-party information service providers to the ZooBurst service harmless from and against all claims. liabilities, losses, expenses, damages and costs, including reasonable attorney 's fees, resulting from (i) any violation of these Usage terms and conditions by user or by any other person accessing the service by using the user's account and/or (ii) claim that any data or content by the user infringes third party rights

c) Copyright and other intellectual property rights
The user declares and confirms by recording data and content to the system/server that he/she is the holder of licenses, rights, approvals or permits according to the relevant regulations which entitle the user to upload protected data and content on the system and to use the data/content by communication to public by the Internet without territorial limitation. The user shall not in particular be entitled to store data or content on the system without prior consent granted by the copyright holder or by the owner or the other intellectual property rights.

Please note that books that you create with the ZooBurst 3D Pop-Up Book Authoring
Environment may be viewed or displayed by members of the ZooBurst team or by other visitors to the ZooBurst website. With that said, your personal privacy is very important to us. Accordingly, we have developed this Policy in order for you to understand how we collect, use, communicate and disclose and make use of personal information. The following outlines our privacy policy.

- The only identifying information that is displayed on the ZooBurst site is your ZooBurst username. Your first name, last name and e-mail address will remain private and hidden to other users at all times.
